ACC Board Chair Ivan Fong Confirmed as Homeland Security GC
We congratulate 2009 ACC Board Chair Ivan Fong on his recent confirmation as General Counsel for the U.S. Department of Homeland Security. Coinciding with this appointment, Mr. Fong resigned as ACC Chair and Board Member, and as of May 1, 2009, the roles has been assumed by Dan Fitz, Executive Vice President, General Counsel & Company Secretary of Misys plc. ACC Unites with Privacy Protection Coalition Against Sunshine in Litigation Act
ACC joined the Coalition to Protect Privacy, Property, Confidentiality and Efficiency in the Courts in an open letter to the U.S. Senate and House Judiciary Committees. The letter explains the Coalition’s opposition to the proposed Sunshine in Litigation Act of 2009, which forces premature discovery decisions and restricts judicial discretion to protect confidentiality. FASB Steps Away From Revised Contingency Reporting Rules
The Financial Accounting Standards Board (FASB) voted on April 1, 2009 to approve amendments to FAS 141(R) on contingency reporting on liabilities assumed in a business combination [visit http://www.fasb.org/pdf/fsp_fas141r-1.pdf]. Moving away from amendments issued in December 2007, the changes effectively return the standards to their original form with regard to reporting litigation related contingencies. While FAS 141(R) is limited to accounting in business combinations, it parallels requirements under FAS 5, which are also facing revisions that have sparked protests from ACC and many others.
