Corporate Executives and Entities Should Not Be Prosecuted for Crimes Committed by Subordinates
On June 6, 2008, the Association of Corporate Counsel (ACC), along with the Chamber of Commerce of the United States, the National (and New York State) Association of Criminal Defense Lawyers (NACDL), the National Association of Manufacturers, and the Washington Legal Foundation joined together to file an amicus brief in United States v. Ionia Management, S.A.  The brief maintains that the failure of lower federal courts to heed the principles of certain cases, and the misreading of the single Supreme Court decision 99 years ago has resulted in the unusual situation that it is currently easier to impute liability in a criminal, rather than a civil case.  For more information on United States v. Ionia Management, S.A., visit the ACC Public Policy page.
