Question of the Month

I am in-house counsel for a multinational corporation and I have been tasked with selecting international outside counsel to handle legal issues in several countries. I do not have personal legal connections in these countries and have limited international law experience. Does ACC have any resources to help guide me through both the selection process and also the management of international outside counsel?

Answer:  Yes, ACC has many resources to assist you with selecting and managing outside counsel. Try the following resources:

Criteria for Selecting International Counsel - June 2009

Multijurisdictional Practice Update
Illinois Becomes 42nd State to Adopt MJP
On July 1, 2009, the Illinois Supreme Court adopted ABA Model Rules 5.5 and 8.5 governing the multijurisdictional practice of law (MJP) and facilitating the cross-border practices of lawyers admitted in one U.S. jurisdiction, but not in the state that’s adopting this practice authorization. To see the status of every state’s MJP reform “docket.” Including information on pro hac vice standards, admission on motion requirements, local office rules and more, go to www.acc.com/advocacy/keyissues/mjp.cfm.

Top Ten Force Majeure Imposters
Broken machinery, the economic downturn, increased fuel costs and unresolved union issues - these circumstances can definitely create challenges for any purchaser or supplier. But do these “soft” excuses really amount to force majeure events that would permit a party to delay or suspend performance or delivery under an agreement, or even to terminate a contract?  This month’s Top Ten discusses the ‘faux majeure’ scenarios prevalent in today’s contracts. To learn more, visit www.acc.com/topten.
