Social Networking in the Business Context—Policies and Procedures
I am General Counsel of an international company and have been asked to develop a comprehensive Social Media Policy for the company. Specifically, I need to create a policy that addresses such mediums as Twitter, Facebook, MySpace, You Tube, Linked In, wikis, blogs and other social networking and community tools, as my company may be developing official pages on some of these sites. In addition, my company needs to provide guidelines to its employees who have their own accounts or who may want to communicate on our behalf. I am concerned about such issues as privacy, defamation, securities laws, FCRA, discrimination and other issues that can come from posting on these sites or using information from these sites in an HR context. Can you provide any guidance on this issue?

ACC Advocacy – We’ve Got You Covered
ACC filed an amicus curiae with the U.S. Supreme Court on January 27 in support of a petition for a writ of certiorari in Textron v. U.S. (Supreme Court Docket No. 09-750). This is the third brief filed by ACC in this dispute between the government and Textron over attorney-work product protections to tax-related documents prepared by the company’s in-house lawyer.
ACC argues that if the First Circuit’s ruling is not overturned, the resulting chilled analyses of litigation scenarios by the in-house attorneys who could best advise their corporate clients will leave company executives less informed than they should be about the legal risks of business decisions.
