Overview

A must see program for all companies that sell products or offer services through dealers, distributors or licensees, whether online through affiliate sales programs or through more traditional licensing or distribution channels.  Even if your company is just beginning to think of establishing such sales strategies, this program will give you the tools you need to implement them successfully. 

Blake Bilstad, Senior Vice President, General Counsel and Secretary of Provide Commerce in San Diego and Lisa Martens, a trademark and copyright Principal with Fish & Richardson, P.C. will discuss specific examples of issues local companies such as Provide Commerce face and share practical advice as to how to address them.  You will learn how to draft effective agreements to protect your intellectual property and how to enforce them after a breach or termination. 

Many companies grapple with dealers/distributors/affiliates who exceed the scope of their license during the agreement or who continue to use the IP of an owner after the termination of an agreement (and essentially become infringers).  This can result in deception of the public, which mistakenly believes these terminated dealers/distributors/affiliates are authorized by or related to the IP owner.  The presentation will provide the important framework for establishing trademark agreements with dealers/distributors/affiliates as well as enforcement actions owners can take after termination of agreements to ensure their valuable IP is not subject to infringement.
