As a general rule, an insurance company who owes its policyholder a “duty to defend” has the right to select the defense counsel who will provide that defense. However, there is an exception to this rule. Pursuant to Civil Code section 2860, if an insurance company reserves its right to deny coverage in such a way that its panel defense counsel could impact coverage in the way he or she defends the case, then the policyholder is entitled to “independent counsel,” sometimes called “Cumis Counsel,” of its own choice, paid for by the insurance company. Cumis Counselcan be extremely valuable to a policyholder, which is probably why insurance companies are loath to agree to them.

During this program, insurance coverage experts from Osborne & Nesbitt LLP will explain 10 things that every general counsel should know about the valuable rights afforded to corporate policyholders by the Cumis Doctrine.
