This presentation will look at the state of the law related to inequitable conduct -- which serves as a defense to an infringement claim when a patent is litigated.  In addition to the policy and ethics framework, we will provide  perspectives of both patent litigators and prosecutors. We will discuss  practical tips to avoid accusations of inequitable conduct and examine how patent reform legislation may allow absolution of past mistakes. The recent Federal Circuit decision in the Therasense case will also be covered.  Ethics credit available.
