A primary role of the position is to help drive the development of QWH's strategy with respect to the development and distribution of FDA (and similar foreign regulatory agency)-regulated devices and QWH's managed services, consistent with QWH's growth goals and applicable global healthcare laws (e.g. HIPAA, HITECH, Stark, Health Reimbursement, Accountable Care Act, etc.) and regulations (e.g. FDA, CE, MHRA, etc.). The position will advise and consult with stakeholders and project managers, as well as with the relevant organizational leaders, on regulatory requirements and developments. The position is responsible for ensuring that regulating body-approved prescribing information for QWH products, global healthcare regulations, and other regulatory best practices, are reflected in QWH's business activities. The position will also be responsible for day-to-day oversight over other legal matters affecting QWH, including commercial contracts (which typically involve managed services, software development & licensing, electronic contracting, hardware development & supply, as well as various marketing arrangements), dispute resolution and intellectual property matters. TEMPORARY GENERAL COUNSEL

LG Mobile has an immediate opportunity for a temporary General Counsel in our San Deigo, CA location (Scripps Ranch). Position shall report to the General Counsel and will be responsible for assisting in due diligence in connection with merger of two LG Electronics companies.
Responsibilities:
1. Review all contracts of acquired entity to determine whether consents or notifications are required from vendors, supplier and customers prior to merger. 
2. Draft notification and consent request letters.
3. Manage consent and notification process with relevant parties.
4. Conduct other due diligence and contract review as required.
5. Draft board and shareholder resolutions and certificates for state filings.
Qualifications:
Education: Juris DoctoratePrior Experience:
Minimum: Experience conducting due diligence and contract review

PROGRAM OVERVIEW
After several years of legislative modifications, patent reform has finally passed Congress and was signed by the President on September 16, 2011. The America Invents Act makes sweeping changes to the American patent system not seen since the Founding Fathers enshrined intellectual property protection into the U.S. Constitution. Now that the law has passed, the United States Patent and Trademark Office (USPTO) will face a flurry of activity implementing the legislation and administering multiple regulatory modifications.

Birch, Stewart, Kolasch & Birch, LLP in partnership with CONNECT is pleased to host this timely Public Policy Forum focused on the America Invents Act and its impact on USPTO with distinguished speakers including:

David Kappos, Under Secretary of Commerce for Intellectual Property and Director of the USPTO: Under Secretary of Commerce for Intellectual Property and Director of the USPTO David Kappos will discuss the USPTO's efforts to start implementing the law and also give a broad perspective of the various changes the agency is undertaking to facilitate the public's understanding of regulatory revisions.

Leonard Svensson, Partner, Birch Stewart, Kolasch & Birch, LLP: Len Svensson will provide a brief overview of the major changes included in the America Invents Act and what the changes means for the San Diego innovation economy.

After their presentations Director Kappos will take questions from the audience.  The Q&A portion of the program will be moderated by Donald Rosenberg, EVP & General Counsel, Qualcomm Incorporated.

ABOUT THE SPEAKERS/PANELISTS:
David Kappos, Director, United States Patent & Trademark Office: Mr. David Kappos is the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office. In this role, he advises the President, the Secretary of Commerce, and the Administration on intellectual property matters. Over a 21-year career in intellectual property, Mr. Kappos has seen all sides of the IP system and its impact on innovation globally. Mr. Kappos directs an office that provides incentives to encourage technological advancement and helps entrepreneurs and businesses of all sizes protect their investments, promote their goods and services and safeguard against deception in the marketplace. The Office is taking steps to deal with patent application backlogs, long waiting periods for patent review, outdated information technology systems that are regarded as outdated and an application process in need of reform.

Leonard Svensson, Partner, Birch Stewart, Kolasch & Birch, LLP: Leonard Svensson has over 30 years of experience in the intellectual property field, specializing in chemical and biotechnology patents, patent interferences, and litigation. He has prepared, filed and prosecuted numerous patent applications in the areas of biotechnology, biochemistry, pharmaceuticals and organic chemistry. Mr. Svensson has represented clients in numerous patent interferences and at all stages of the proceedings, prepared, filed and prosecuted a variety of reexamination and reissue applications and handled numerous appeals, including Oral Hearings, before the U.S. Board of Patent Appeals and Interferences. Mr. Svensson is experienced in District Court patent infringement litigations and has counseled clients and prepared numerous opinions analyzing patent validity and infringement issues.

Donald Rosenberg, Executive Vice President, General Counsel and Corporate Secretary of Qualcomm Incorporated
Donald Rosenberg is Executive Vice President, General Counsel and Corporate Secretary of Qualcomm Incorporated. In his role as Chief Legal Officer, Rosenberg is responsible for overseeing Qualcomm's worldwide legal affairs including litigation, intellectual property and corporate matters. Qualcomm's Government Affairs and Strategic Intellectual Property organizations also report to Rosenberg. Prior to joining Qualcomm, Mr. Rosenberg served as Senior Vice President, General Counsel and Corporate Secretary of Apple Inc. Prior to that he was Senior Vice President and General Counsel of IBM Corporation where he also held numerous positions including Vice President and Assistant General Counsel for litigation and counsel to IBM's mainframe division.
